Terms of service

1. What the service does
Nightjar periodically fetches public pages from websites designated by the customer, inspects their HTML, TLS certificate and DNS records, and reports what it finds — including what has changed since the previous inspection. It is aimed at professionals acting in the course of their business.
2. Authorisation to monitor
The customer warrants that they are entitled to have each site monitored —
because they own it, operate it, or have been engaged by whoever does. Nightjar honours
robots.txt and will block any domain on request from its operator, including
against a paying customer's wishes.
3. Accounts and recovery
Sign-up needs a valid email address and a password. A recovery code is displayed once and is the only way back into an account with a lost password. The publisher stores only a hash of it and cannot recover it. Losing it means losing access to the account.
4. Plans and payment
The free plan has no time limit, within the caps published on the pricing page. Paid plans are billed monthly or yearly in advance, in US dollars, by card through Stripe. VAT is not applicable under article 293 B of the French tax code. Prices may change; running subscriptions keep their agreed price until renewal.
5. Cancellation
Subscriptions renew automatically and can be cancelled at any time from the customer's own dashboard, without giving a reason. Cancellation takes effect at the end of the period already paid for, which is not refunded. The account then returns to the free plan; nothing is deleted, and sites beyond the free allowance are paused rather than removed.
6. Right of withdrawal
The service is sold to professionals, so the consumer right of withdrawal does not apply. A customer acting as a consumer has fourteen days to withdraw; by asking for immediate access they waive that right, as provided by article L221-28 of the French consumer code.
7. What the reports are, and are not
Nightjar reports observations, not guarantees. It reads HTML as delivered and does not execute JavaScript, so it can miss things a browser would see, and it inspects a sample of pages rather than the whole site. A clean report is not a warranty that a site is correct, secure, accessible or compliant with any standard. Decisions taken on the basis of a report remain the customer's own.
8. Availability
The publisher takes reasonable care to keep the service running but offers no measured uptime commitment. Scans may be delayed or skipped during maintenance or incidents. Nightjar is not an uptime monitor and must not be relied upon as one.
9. Acceptable use
The customer must not use the service to:

monitor sites they have no right to monitor;
- ·
probe, stress or map infrastructure belonging to others;
- ·
circumvent the crawl budgets or rate limits of their plan.
The publisher may suspend an account that breaches this clause, without notice or refund.
10. Liability
Liability is limited to direct loss and may not exceed the amount paid by the customer in the twelve months preceding the event. It does not extend to lost profits, lost traffic, lost rankings, or damage to reputation — including where a fault went undetected by the service.
11. Deleting your account
Accounts can be deleted at any time from the dashboard; sites, scans and issue history are erased immediately and permanently. Deleting the account does not cancel the Stripe subscription, which must be cancelled from the Billing tab first.
12. Governing law
These terms are governed by French law. Failing amicable resolution, disputes fall to the courts having jurisdiction over the publisher's registered office.
